Having spoken to many people who have an active interest in the case, the general consensus is that the PCG will not win the case. However, not all will be lost....
The judge needs to make a decision before the end of the tax year rather than refer the decision.
Even if the PCG do lose, it is very likely that the judge will make recommendations to the Inland Revenue to sort their act out. The Judge was not impressed with the uncertainty factor when judging whether contracts fall inside or outside of IR35.
This will be good news for contractors that are genuine business, as opposed to those that are purely used as tax vehicles. Definitely a win for small businesses and entrepreneurs, and definitely a win for the IR against tax avoiders (and quite right to!).
For those of you who have been on another planet for the past few days, the result is due on Monday at 10.30.
